1. Acceptance of terms
By creating an account or using Graftie ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of service
Graftie is a trade business management platform providing AI-powered quoting, scheduling, invoicing, compliance certificates, customer management, and messaging features for UK trades businesses.
3. Accounts and eligibility
- You must be at least 16 years old to create an account.
- You must provide accurate information during sign-up.
- You are responsible for maintaining the security of your account and password.
- You are responsible for all activity under your account.
- One person or business entity per account.
4. Plans and pricing
- We offer a Free plan with limited features and paid plans (Pro, Business, Enterprise) with additional features.
- Paid plans are billed monthly via Stripe. You can cancel at any time.
- Annual billing may be available at a discount. See our pricing page for current rates.
- All prices are in GBP (£) and include VAT where applicable.
- We may change our pricing with at least 30 days notice. Existing subscribers keep their current rate until the next renewal.
5. Acceptable use
You agree not to:
- Use the Service for any illegal or unauthorised purpose
- Upload or transmit viruses, malware, or malicious code
- Attempt to access other tenants' data or circumvent security measures
- Abuse, overload, or disrupt the Service (including excessive API calls)
- Use the AI features to generate harmful, misleading, or fraudulent content
- Scrape, copy, or redistribute data from the Service without permission
- Resell or sublicense access to the Service without our written consent
6. Your content and data
- You retain all rights to the data you enter into Graftie (customers, jobs, quotes, invoices, certificates, etc.).
- You grant us a licence to process your data solely to provide the Service.
- You are responsible for ensuring you have the right to store any personal data you enter (e.g. customer contact details) and that you comply with data protection law.
- You can export your data at any time. We provide CSV and JSON export for key data types.
7. AI-generated content
- AI features (quotes, messages, certificate drafts) are generated by third-party AI models and may contain errors.
- AI-generated content is a suggestion, not a final product. You are responsible for reviewing and approving all AI output before sending it to customers.
- We do not guarantee the accuracy, completeness, or fitness for purpose of AI-generated content.
- You should not rely solely on AI output for compliance-critical documents (e.g. Gas Safety certificates) without professional review.
8. Intellectual property
- The Service, including its design, code, and branding, is owned by Graftie and protected by UK and international intellectual property law.
- Trade presets, certificate templates, and default content are provided for your use within the Service.
- You may not copy, modify, or redistribute the Service or its components without our written consent.
9. Service availability
- We aim for high availability but do not guarantee uninterrupted service. We may experience downtime for maintenance, updates, or events outside our control.
- We are not liable for any downtime, data loss, or business interruption resulting from Service unavailability.
- We will provide notice of planned maintenance where possible.
10. Termination
- You can cancel your subscription at any time. You will retain access until the end of your current billing period.
- We may suspend or terminate your account if you breach these Terms.
- We may terminate the Service with 30 days notice.
- Upon termination, your data will be deleted within 60 days, unless retention is required by law.
11. Limitation of liability
- The Service is provided "as is" without warranties of any kind.
- To the maximum extent permitted by law, Graftie is not liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim is limited to the amount you paid in the 12 months preceding the claim.
- We are not liable for any loss of data, revenue, profits, or business opportunity resulting from your use of the Service.
12. Governing law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
